These Terms of Service govern your use of jennscandlegarden.ca and purchases from Jenn's Candle Garden. By using the website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Return and Refund Policy, and any product-specific instructions. If you do not agree, please do not use the website.

About this store

Jenn's Candle Garden is a small Canadian candle business based in New Brunswick. Our online store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.

Eligibility and accounts

You must be the age of majority in your province or territory, or have permission from a parent or legal guardian, to place an order. You are responsible for providing accurate account, billing, contact, and shipping information and for protecting any account credentials.

Handmade products

Our candles are handmade in small batches. Small variations in colour, scent, flower placement, finish, shape, and appearance are part of their handmade character. Product photographs and screen colours are illustrative, and minor variations are not normally defects. Product descriptions, dimensions, materials, and safety information on the applicable product page form part of these Terms.

Candle safety

Candles involve an open flame and hot wax. Follow every warning label and the Candle Care & Safety instructions supplied with the product or published on our website. Never leave a burning candle unattended; keep it away from children, pets, drafts, and flammable materials; use a stable, heat-resistant surface; and discontinue use if the candle or container is damaged or behaves unusually. These instructions do not limit any legal responsibility that cannot be excluded by law.

Orders, availability, and pricing

All orders are subject to acceptance, payment authorization, and product availability. Adding an item to a cart does not reserve it. We may contact you to verify an order or correct an obvious listing, pricing, inventory, or payment error before fulfillment. If we cannot fulfill an order, we will cancel the affected item and refund the amount paid for it.

Prices are shown in Canadian dollars unless the store states otherwise. Applicable taxes and shipping charges are shown at checkout. Discounts, promotions, and offers are subject to their stated conditions and may be changed or ended as permitted by law.

Custom, wedding, event, and bulk orders

Submitting a custom-order form is an inquiry and does not create an order or guarantee availability. A custom order is confirmed only after the design details, price, payment requirements, and estimated completion date have been accepted. Requested dates are not guaranteed until confirmed in writing.

Contact us as soon as possible to request a change or cancellation. Changes or cancellations are not guaranteed after materials have been ordered or production has started, and approved changes may affect the price and completion date. Custom, personalized, wedding, event, and bulk orders are final sale except when an item is damaged, defective, incorrect, or applicable law requires another remedy.

Shipping, returns, and refunds

Processing and delivery information is set out in our Shipping Policy. Return, damage, exchange, and refund terms are set out in our Return and Refund Policy. Those policies form part of these Terms.

Website use

You may use this website only for lawful personal or business purchasing purposes. You must not interfere with the website's security or operation, attempt unauthorized access, introduce malicious code, scrape or copy the website for an unlawful purpose, misuse another person's information, or use the website in a way that violates applicable law or another person's rights.

Intellectual property

The website's original branding, photographs, product designs, text, graphics, and other content belong to Jenn's Candle Garden or are used with permission. You may not reproduce, sell, publish, or commercially exploit them without prior written permission, except as permitted by law.

Third-party services and links

The website may use or link to services operated by Shopify, payment providers, carriers, social platforms, and other third parties. Their services may be governed by their own terms and privacy policies. We are not responsible for third-party websites that we do not control.

Service availability and legal rights

We work to keep product information and the website accurate and available, but temporary errors, interruptions, or delays may occur. To the extent permitted by law, the website is provided on an as-available basis. Nothing in these Terms excludes or limits a warranty, remedy, liability, or consumer right that cannot legally be excluded or limited, including rights relating to defective goods, fraud, gross negligence, or personal injury where applicable.
